The short version: Blumvie is free to use, with an optional subscription billed through Apple. The quotes are there to encourage you. They are not professional advice. Please use the app lawfully and do not copy its content in bulk.

1. Agreement

Blumvie is operated by Derek Lauritzen, based in Illinois, USA. These terms are an agreement between you and Derek Lauritzen, doing business as Blumvie ("Blumvie", "we", "us"), covering your use of the Blumvie app and the website blumvie.com. By using the app or the website you agree to these terms. If you do not agree, please do not use them.

2. Using Blumvie

We give you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices you own or control, as permitted by the App Store's usage rules. You agree not to:

3. Blumvie Premium

Some features require a paid subscription, Blumvie Premium, sold through Apple's App Store.

4. Content

Quotes in Blumvie are attributed to the people who said or wrote them and are presented for commentary and inspiration. The short explanations that accompany them are written by Blumvie. We work to attribute quotes accurately, but we cannot guarantee that every quote or attribution is free of error. If you believe something is wrong, tell us at [email protected] and we will review it.

Blumvie is not affiliated with, sponsored by or endorsed by any person quoted in the app.

Including a quote does not mean Blumvie endorses the wider views, actions or beliefs of the person quoted. Each quote is shared for the thought it expresses.

If you own rights in any content shown in the app and believe it is used improperly, contact us with the details and we will respond promptly.

5. Not professional advice

Blumvie is intended for general encouragement and reflection. It is not medical, psychological or other professional advice, and it is not a substitute for care from a qualified professional. If you are struggling or in crisis, please contact a qualified professional or your local emergency services.

6. Ownership

The app, its design, the Blumvie name and logo, and the explanations written for each quote belong to Blumvie and are protected by intellectual property laws. These terms do not give you any rights in them beyond the license in section 2.

7. Privacy

Our Privacy Policy explains what information the app uses and how.

8. Availability and changes

We may update, change or discontinue the app or any of its features. We may also update these terms. When we do, we will post the new version here and update the date at the top. Continuing to use Blumvie after a change means you accept the updated terms.

9. Disclaimers

Blumvie is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the app will be uninterrupted or free of errors.

10. Limitation of liability

To the fullest extent permitted by law, Blumvie will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of the app or the website. Our total liability for any claim relating to the app is limited to the amount you paid for Blumvie Premium in the twelve months before the claim arose. Some jurisdictions do not allow these limits, so they may not apply to you, and nothing in these terms limits rights you have under consumer protection law.

11. Apple

These terms are between you and Blumvie, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to meet any applicable warranty, you may notify Apple, which may refund the purchase price, and to the fullest extent permitted by law Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory, consumer protection or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a United States government embargo and are not on any United States government list of prohibited or restricted parties.

12. Governing law

These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law rules, except where the consumer protection law of your country of residence gives you rights that cannot be waived.
